The obligation
The Minister for Employment Protection approved the Working Hours code in April 2006 under section 57 of the OSH Act and section 93 of the MSI Act.
Transition arrangements allow codes approved under the OSH Act and MSI Act to continue in effect as if approved by the Minister under the WHS Act. Codes of practice published under these Acts give practical guidance on how to comply with general or specific duties under the legislation. Industry-specific codes on working hours or fatigue management can be submitted to the Commission for approval under section 57 of the OSH Act, giving them the same status as other approved codes.
