The obligation
The Regulations set minimum election procedures for health and safety representatives, bar PCBUs from unreasonably delaying elections, and set HSR training requirements.
The person conducting an HSR election must take all reasonable steps to ensure each relevant PCBU is told the election date as soon as practicable. All workers in the work group must have an opportunity to nominate and vote, and all workers and relevant PCBUs must be told the outcome. A PCBU at a workplace must not unreasonably delay the election of a health and safety representative; fines apply to individuals and bodies corporate. …
