The obligation
PCBUs must consult with workers who are, or are likely to be, directly affected by a work health and safety matter, as required by the WHS Act 2020 (WA) and this Code.
Under the Work Health and Safety Act 2020 (WA), PCBUs have a duty to consult workers who carry out work for the business and who are (or are likely to be) directly affected by a WHS matter. The Code of Practice provides practical guidance on how to meet this duty, including when consultation must occur (e.g. risk identification, change to work systems), what it must involve, and how outcomes must be shared. Failure to consult is an enforceable breach of the Act.
