The obligation
PCBUs that manage or control fixtures, fittings or plant, or design, manufacture, import, supply or install plant, substances or structures, have further duties.
A PCBU with management or control of fixtures, fittings or plant at a workplace must ensure, so far as is reasonably practicable, that they are without risks to the health and safety of any person. This does not include the occupier of a residence unless it is occupied for, or as part of, a business or undertaking, or a prescribed person. Separate duties apply to PCBUs that design plant, substances or structures to be used, or reasonably expected to be used, at a workplace.
