The obligation
Manufacturers and importers must prepare an SDS for each hazardous chemical they produce or import into Australia, unless the chemical is exempt under WHS Regulations.
Under the WHS (General) Regulations 2022 (WA), a manufacturer or importer of a hazardous chemical must prepare a safety data sheet (SDS) for that chemical before it is supplied. The SDS must contain the 16 sections specified in the GHS/ASDS format, include all required hazard information, and be updated when new information about the chemical becomes available. Exempt chemicals (e.g. below concentration thresholds) do not require an SDS.
