The obligation
A person managing or controlling plant must ensure it is used only for its designed purpose, unless an assessment shows the proposed use does not increase risk.
Under r. 206 of the WHS General and Mines Regulations, a person with management or control of plant at a workplace must take all reasonable steps to ensure the plant is only used for the purpose for which it is designed, unless they have assessed that the proposed use does not increase the risk to health and safety. In making that assessment, they must ensure the risk of the proposed use is assessed by a competent person.
