The Code applies to any PCBU that uses, handles, generates, or stores hazardous chemicals at a workplace. A hazardous chemical is any substance, mixture or article meeting one or more GHS hazard-class criteria. Compliance with the code assists duty-holders to satisfy obligations under the WHS Act 2020 (WA) and WHS (General) Regulations 2022. Failure to follow the code is not an offence, but non-compliance may be used as evidence in proceedings.
