Under the Food Regulations 2009 (WA) and Food Act 2008 (WA), it is an offence to conduct a food business at any premises without registering with the appropriate enforcement agency. Registration applies to fixed premises, market stalls, food trucks, and other mobile food businesses. Enforcement is primarily by local governments and the WA Department of Health. Businesses must also comply with the Australia New Zealand Food Standards Code including Chapter 3 Food Safety Standards.
