The obligation
Part 5 of the Food Act 2008 lets authorised officers enter and inspect food premises and vehicles and seize things that are evidence of an offence.
Under section 38, an authorised officer may, at any reasonable time, enter and inspect any premises reasonably believed to be used in connection with handling food intended for sale or the sale of food, or any food transport vehicle. This does not authorise entry into parts of premises used solely as a residence, except with the occupier's consent, under a warrant issued under section 42, or where that part is used to prepare or serve meals provided with paid accommodation.
