The obligation
If asbestos was installed in a non-domestic property after 1 January 2004, the duty-holder must notify WorkSafe Victoria and agree to remove or manage the asbestos.
Where asbestos is found to have been installed after the national ban date (1 January 2004) in any non-domestic premises, the person in control must notify WorkSafe Victoria and then enter an agreement to either remove the asbestos or manage the risk through an approved management plan. This obligation does not apply to premises used solely as domestic residences. This is a separate, specific duty over and above the general asbestos management obligations.
