The obligation
Employers, self-employed persons, and persons in control of Victorian workplaces must identify, assess, and manage asbestos and ACM under OHS Regulations 2017 Part 4.4.
Under OHS Regulations 2017 Part 4.4, Victorian duty-holders must: identify the presence of asbestos or ACM at the workplace; prepare and maintain an asbestos register; develop and implement an asbestos management plan where asbestos is present; ensure workers who may disturb asbestos are informed; arrange for asbestos/ACM to be labelled. The compliance code specifies practical steps to meet each of these duties. Failure to comply with the regulations (not just the code) attracts penalties.
