The obligation
A person in management or control of land must notify the Authority of notifiable contamination as soon as practicable after becoming, or when they reasonably should have become, aware of it.
Land is contaminated if waste, a chemical substance or a prescribed substance is on or under its surface above the background level and creates a risk of harm to human health or the environment. Notice is not needed if the person knows a notification has already been made, or the contamination is prescribed exempt notifiable contamination. Notice must be in a form approved by the Authority, and information not known when notifying must be given as soon as practicable after the person learns it.
