The obligation
PCBUs must consult workers who carry out work for the business and are directly affected by a WHS matter. Consultation must be genuine, timely, and allow workers to contribute before decisions are made.
Under the WHS Act 2012 (Tas) and the Code, PCBUs must consult affected workers when: identifying or assessing hazards/risks; making decisions about risk controls; making decisions about the adequacy of welfare facilities; proposing changes to work or the work environment; and making decisions about consultation procedures. Consultation requires sharing relevant information, giving workers a reasonable opportunity to express views, and taking those views into account.
