The obligation
PCBUs must eliminate or minimise, so far as is reasonably practicable, the risk of sexual and gender-based harassment at work under the WHS Act 2012 (Tas) and this Code.
Under the Code and the Work Health and Safety Act 2012 (Tas) s 19, PCBUs have a primary duty of care to provide a safe working environment free from sexual and gender-based harassment. The Code requires PCBUs to: conduct a risk assessment; consult workers; implement controls (including policies, training, and reporting mechanisms); and review controls periodically. The duty is proactive — PCBUs must not wait for a complaint before acting.
