The obligation
Some hazardous chemicals are excluded from the regulation 335 labelling provisions or exempt from Part 7.1 of the WHS Regulations, and chemicals in transit need no WHS label.
In general, a label is required for any substance, mixture or article classified as a hazardous chemical under the WHS Regulations, but several types are excluded from the regulation 335 labelling provisions or exempted from all of Part 7.1. Hazardous chemicals in transit do not require labelling under WHS laws; their packaging and labelling are set by transport laws and codes such as the Australian Code for the Transport of Dangerous Goods by Road and Rail.
