The obligation
PCBUs must ensure any substance, mixture or article classified as a hazardous chemical under the WHS Regulations carries a compliant label before supply or use in the workplace.
The Code establishes that a label is required for any hazardous chemical as classified under the WHS Regulations. The PCBU who manufactures or imports the chemical bears the primary labelling duty. Labels must be in English, legible, durable, and affixed to the container. The Code is an approved Code of Practice under s.274 of the Work Health and Safety Act 2012 (Tas); compliance with it is taken to satisfy the relevant WHS Regulations duties.
