The obligation
A person managing or controlling a workplace must identify asbestos or ACM, or assume it is present, and may arrange for samples to be analysed.
A person with management or control of a workplace must assume material is asbestos or ACM if it cannot be identified but a competent person reasonably believes it is. Asbestos must also be assumed present where part of the workplace is inaccessible and likely to contain asbestos or ACM. A competent person is not needed if asbestos is assumed present or there are reasonable grounds to believe it is not present.
