The obligation
The 2009 Regulations were revoked on 1 April 2024 and replaced by a remade set as part of the mandatory 10-year subordinate legislation review. Operators must comply with the new 2024 Regulations.
Following the mandatory 10-year review and expiry cycle for South Australian subordinate legislation, the SA Government approved the remake of the Environment Protection Regulations. The 2009 Regulations were formally revoked on 1 April 2024 by Schedule 6, clause 1 of the new Environment Protection Regulations 2024. All environmental authorisation holders, licensed operators, and duty-holders previously subject to the 2009 Regulations must now comply with the replacement instrument.
