The obligation
A person must not undertake an activity that pollutes, or might pollute, the environment unless they take all reasonable and practicable measures to prevent or minimise resulting harm.
In deciding what measures are required, regard is had to the nature of the pollution or potential pollution and the sensitivity of the receiving environment. The financial implications of the possible measures, as they relate to persons undertaking the same or similar activities, are also considered.
