Health and safety duties cannot be transferred, a person can hold more than one duty, and more than one person can hold the same duty concurrently.
These principles apply to all duties under the Act, including duties relating to incident notification and consultation. Each duty holder must comply with a duty to the standard required by the Act even if another duty holder has the same duty.
