The obligation
A PCBU must not erect or dismantle scaffolding where a person could fall 3m (housing construction) or 2m (other construction) unless the fall risk is controlled.
Under WHS Regulation section 306P, a PCBU must not erect, or allow another person to erect, scaffolding where a person could fall 3m for housing construction work or 2m for all other construction work. Section 306Q applies the same limits to dismantling scaffolding. The work may proceed only if a control measure prevents a person from falling, a fall arrest system is used, or the PCBU follows the erection process in section 306P(4) or the dismantling process in section 306Q(3)(b).
