The obligation
Manufacturers and importers of hazardous chemicals must prepare an SDS before first supply; sets out when an SDS is and is not required.
Under the Code, a manufacturer or importer of a hazardous chemical must prepare a safety data sheet (SDS) before first supplying the chemical. The SDS must be prepared, reviewed and amended in accordance with the Code. Certain chemicals are exempt (e.g. those below hazard classification thresholds). The duty holder must ensure the SDS is accurate, current and available to downstream users and workers.
