The obligation
The Food Act 2006 binds all persons except the State, government owned corporations and rail government entities, and exempts some school tuckshop and charity home-baking activities.
The Act binds all persons, but does not bind the State, a government owned corporation or a rail government entity under the Transport Infrastructure Act 1994 (s 3). It does not apply to handling or selling food at a tuckshop run by a parents and citizens association at a State school (s 4). It also does not apply to handling food at a person's home that is to be given away to a non-profit organisation for sale by that organisation, such as a cake baked for a club fundraising stall.
