The obligation
Requirements for obtaining and holding an environmental authority (EA) for scheduled environmentally relevant activities, including application, conditions, and compliance obligations.
The EP Regulation 2019 prescribes which activities are environmentally relevant activities (ERAs), the thresholds and categories that trigger a requirement for an environmental authority, and the procedural and substantive conditions that apply. Duty-holders (operators, proponents) must obtain an EA before commencing a scheduled ERA and comply with all conditions. Non-compliance can attract enforcement action under the EP Act 1994.
