The obligation
Designers, manufacturers, importers, suppliers and installers of plant or structures used in demolition must ensure, so far as reasonably practicable, they are without health and safety risks.
This duty includes carrying out testing and analysis and providing specific information about the plant or substance. The WHS Regulation also requires manufacturers to consult with designers of plant, and importers to consult with designers and manufacturers of plant. The Code refers designers to WHS Act section 22 and to WHS Regulation section 295, under which a designer must give a safety report to the person who commissions the design.
