The obligation
PCBUs must immediately notify NT WorkSafe of notifiable incidents (deaths, serious injuries/illness, dangerous incidents) and preserve the incident site.
Sections 35–38 require PCBUs to immediately notify the regulator (NT WorkSafe) of any notifiable incident (death of a person, serious injury or illness, or dangerous incident) arising from work. Notification must be immediate (oral or written) with a written follow-up within 48 hours. The incident site must be preserved until an inspector attends or 48 hours elapse, whichever is first. Failure to notify is a Category 2 offence.
