The obligation
PCBUs must, so far as reasonably practicable, work at ground level or on solid construction, provide safe access, and implement fall prevention controls in hierarchy order.
Under the Code and the WHS Regulations (NT), PCBUs must: (1) ensure work involving fall risk is carried out at ground level or on solid construction so far as reasonably practicable; (2) provide safe means of access to and egress from the workplace; (3) minimise residual fall risk by providing fall prevention devices (first priority), work positioning systems (second), or fall arrest systems (third). Failure to follow the Code may be relied on as evidence of a breach of the WHS Act duty of care.
