The obligation
PCBUs must ensure, so far as reasonably practicable, the health and safety of workers by identifying and managing psychosocial hazards as part of their primary duty of care under the WHS Act (NT).
Under the NT Code and the WHS (National Uniform Legislation) Act 2011, a Person Conducting a Business or Undertaking (PCBU) has a primary duty to manage risks to both physical and psychological health. This includes identifying psychosocial hazards (e.g. high job demands, poor support, violence, bullying), assessing their risks, and implementing controls so far as reasonably practicable. The duty applies to all workers and other persons affected by work carried out under the PCBU.
