The obligation
The Code is an approved code of practice under section 274 of the WHS (National Uniform Legislation) Act 2011 and applies to all workplaces where asbestos removal is carried out.

Codes of practice are admissible in court proceedings, and courts may rely on the Code in determining what is reasonably practicable. Compliance may be achieved by another method that provides an equivalent or higher standard of work health and safety. An inspector may refer to the Code when issuing an improvement or prohibition notice.
