The obligation
PCBUs conducting or managing abrasive blasting in the NT must comply with this approved Code under s 274 WHS Act (NT). Courts may treat the Code as evidence of what is reasonably practicable.
The NT Abrasive Blasting Code of Practice applies to all NT workplaces where abrasive blasting is carried out. It is approved under s 274 of the Work Health and Safety (National Uniform Legislation) Act 2011 (NT). PCBUs have a primary duty to manage risks associated with abrasive blasting; compliance with the Code is not mandatory but satisfies the WHS Act if followed. Non-compliance does not automatically breach the Act but courts may rely on the Code when assessing reasonable practicability.
