The Work Health and Safety Amendment (Industrial Manslaughter) Act 2024 No 43 introduced industrial manslaughter as a criminal offence under the NSW WHS Act. As at the scan date, Schedule 1[4] (omission of s 229B(3)) is listed as not yet commenced on the NSW Legislation website. Organisations and officers may face significant liability where a person's death is caused by a PCBU's conduct.
