NSW adopted the Code of Practice for Sexual and Gender-Based Harassment in June 2024, imposing WHS-based duties on PCBUs to eliminate or minimise harassment risks at work.
SafeWork NSW issued this Code of Practice on 28 June 2024 under the Work Health and Safety Act 2011 (NSW). PCBUs must manage sexual and gender-based harassment as a health and safety risk using a four-step process: identify hazards, assess risks, implement controls, and review. The Code applies to all NSW workplaces and workers, including contractors and volunteers. Non-compliance with the Code may be used as evidence in WHS prosecutions.
