The obligation
The Code requires PCBUs to follow a four-step WHS risk management process: identify hazards, assess risks, implement controls, and review measures.
PCBUs must systematically manage sexual and gender-based harassment as a workplace health and safety hazard. Step 1: Identify harassment hazards (e.g. power imbalances, isolated work, client-facing roles). Step 2: Assess the risk level. Step 3: Implement control measures (hierarchy of controls applies). Step 4: Review the effectiveness of controls. Workers must be consulted throughout the process. Failure to follow this process may constitute a breach of the WHS Act 2011 (NSW).
