The obligation
People who manufacture or use an industrial chemical listed in the NSW IChEMS register must comply with its risk management measures and must not do things it prohibits.
Section 296A applies the Commonwealth register, as modified by the regulations, as the NSW Industrial Chemicals Environmental Management Standard Register (NSW IChEMS register). Under section 296B, a person who manufactures or uses a listed industrial chemical must comply with the register's risk management measures, and a failure to comply is taken to be a pollution incident.
