The obligation
Identifies which persons (manufacturers, importers, suppliers) are required to prepare and provide an SDS for hazardous chemicals under the CoP and WHS Regulation 2017.
The CoP, approved under s274 WHS Act 2011 (NSW), applies to manufacturers, importers, and suppliers of hazardous chemicals. These duty-holders must prepare an SDS before the chemical is first supplied, and must provide it to downstream users on request or at first supply. The CoP cross-references the WHS Regulation 2017 (NSW) Part 7.1 obligations. Exemptions exist for certain chemicals that do not meet the classification threshold.
