The obligation
PCBUs must eliminate risks from moving plant on NSW construction sites, or if not reasonably practicable, minimise them — backed by WHS Act ss.19, 46, 47 and WHS Reg s.55C.
Under the 2025 code, PCBUs bear primary duty to eliminate, or where not reasonably practicable minimise, risks from moving plant. Obligations include: maintaining a safe work environment; providing traffic management plans; ensuring plant is fit for purpose and maintained; ensuring operators are trained and competent; consulting workers and affected parties.
