The obligation
SafeWork NSW's December 2025 approved Code of Practice replaces the 2004 WorkCover code, aligning guidance with current WHS Act 2011 duties for PCBUs managing moving plant risks at NSW construction sites.
The new code was approved under WHS Act 2011 s.274, gazetted and commenced 12 December 2025. It replaces the 2004 Moving Plant on Construction Sites code. Key updates: duty-holder framework updated to PCBU model (WHS Act ss.19, 46, 47 and WHS Reg s.55C); mandatory eliminate-or-minimise hierarchy; requirements for traffic management plans, segregation of workers and plant, operator competency, and risk assessment/consultation.
