The obligation
The Code applies to all PCBUs who design, construct, import, supply or install plant or structures where a fall from one level to another could cause injury.
The Code of Practice: Managing the Risk of Falls at Workplaces is approved under s274 of the WHS Act 2011 (NSW). It applies to PCBUs and extends to those who design, construct, import, supply or install plant or structures. Duty holders must ensure, so far as is reasonably practicable, that work involving fall risk is carried out on the ground or solid construction, that safe access/egress is provided, and that fall risk is minimised using the hierarchy of controls.
