The obligation
Food Regulation 2025 introduces mandatory licensing and notification requirements for businesses producing berries, leafy vegetables and melons in NSW.
The Food Regulation 2025 introduces new licensing and notification obligations for primary producers of berries, leafy vegetables and melons — high-risk produce categories linked to foodborne illness outbreaks. Businesses in these sectors must obtain applicable licences and/or notify the NSW Food Authority before or during operation. Failure to comply may attract penalties under the Food Act 2003 (NSW). This is a substantive new obligation compared to the 2015 Regulation.
