The obligation
The 2004 NSW BBV Code of Practice has been replaced by a new approved Code gazetted 22 May 2026 under the WHS Act 2011.
SafeWork NSW approved 'How to manage blood-borne virus exposure risks in the workplace – hepatitis B, hepatitis C and HIV' under s 274 of the NSW WHS Act 2011, gazetted and commenced 22 May 2026. The new Code replaces the 2004 Code outright. PCBUs with BBV exposure risks must rely on the new Code for compliance guidance; the 2004 Code is no longer operative.
