The model Code must be separately approved in each state/territory to have legal effect. Compliance professionals must check with each relevant jurisdiction's regulator to confirm operative status.
As a model Code developed by Safe Work Australia, Safe Design of Structures does not automatically have legal force. Each jurisdiction (NSW, VIC, QLD, SA, WA, TAS, ACT, NT) must formally approve it under its local WHS legislation. Approved versions may differ slightly from the national model.
