The obligation
Rules may prohibit export of regulated waste material unless prescribed export conditions are met. Exporters must hold a valid export licence and comply with conditions set under the Rules.
Under Chapter 2 of the Act, the Minister may make rules prescribing waste materials as 'regulated waste material' and prohibiting or conditioning their export. Exporters must obtain an export licence (Part 4), comply with licence conditions, notify the Minister of certain events (s.61), and must not make false or misleading representations about regulated waste material or in export declarations (ss.21–24). Export licences may be varied (Part 6) or suspended (Part 7).
