Rail transport operators must, so far as is reasonably practicable, ensure the safety of their railway operations, including rolling stock and infrastructure under their management.
The Rail Safety National Law imposes a primary duty on rail transport operators to ensure, so far as is reasonably practicable (SFAIRP), the safety of all aspects of their railway operations. This duty extends to employees, contractors, passengers, and others who may be affected. Operators must hold accreditation from ONRSR and maintain a safety management system (SMS) as a condition of operating. Breach of the primary duty attracts significant civil and criminal penalties.
