The obligation
Mandatory product stewardship regulations can impose binding obligations on manufacturers, importers, distributors, and retailers of specified products.
Under Part 3 of the Act, the Minister may declare a product subject to mandatory product stewardship. Liable parties (manufacturers, importers, distributors, retailers) must satisfy product stewardship criteria and further the objects of the Act (s 39). Failure to comply can attract civil penalties. Mandatory obligations are activated by subordinate instruments (regulations or rules) for specific product classes.
