The obligation
The WHS Regulation requires PCBUs to review fatigue control measures when controls are inadequate, before workplace changes, or in other prescribed circumstances.
As part of the risk management process, the WHS Regulation mandates review of implemented fatigue control measures in specified circumstances: (a) when the control measure is not eliminating or minimising fatigue risks so far as reasonably practicable; (b) before a change at the workplace likely to give rise to a new or different fatigue risk; and (c) in other circumstances prescribed by regulation. Failure to review controls may constitute a breach of the WHS Regulation.
