The obligation
The 2025 Amendment Act empowers the NHVR (not Ministers) to issue, amend, and revoke codes of practice guiding compliance with HVNL duties, subject to consultation requirements.
Under the 2025 Amendment Package, authority to create and maintain codes of practice is shifted from Ministers to the National Heavy Vehicle Regulator. The NHVR must follow a prescribed consultation process before issuing or revoking a code. Codes of practice provide practical guidance on how CoR parties can meet their safety duties. Non-compliance with a code may be used as evidence in enforcement proceedings.
