FSANZ may make urgent variations to the Food Standards Code without standard consultation where an immediate risk to public health exists.
The Act empowers FSANZ to prepare and gazette urgent variations to the Code when there is an imminent or existing risk to public health and safety. Urgent variations take immediate effect upon gazettal. Food businesses must monitor for urgent variations as they may impose immediate compliance obligations (e.g. withdrawal of a substance or product from market) with no transitional period.
