The Code applies to all PCBUs and officers where work is performed in or near a confined space, imposing specific duties under the WHS Act and WHS Regulation.
Under the model WHS framework, a PCBU must ensure risks associated with confined spaces are managed. The Code applies to any space that is large enough to enter, has restricted entry/egress, and is not designed for continuous occupancy. Officers have due-diligence duties. The Code sits under WHS Act s 274 and WHS Regulation cl 66.
